This website is operated by Ourivesaria Santos. In this sense, throughout the site, the terms “we”, “us” and “our” refer to it as a brand. By visiting our website and/or purchasing an item, you are intrinsically involved in the services provided by the brand and agree to all of the following terms and conditions.
Please read these Terms and Conditions of Use carefully before navigating our server. Any new features or tools which are added to the current store shall also be subject to the Terms of Use.
The Santos brand assumes responsibility and commitment to respect the security of this website and protect the data provided by its customers and visitors, as previously mentioned.
1. Scope and Purpose of the General Conditions
These General Conditions are intended for the promotion, dissemination and sale to the public (online/virtual website) of jewellery and similar products from brands and modern products sold by Ourivesaria Santos.
These general conditions apply to all visitors and users of the website, as well as to all commercial transactions carried out through said platform.
By agreeing to these terms, you declare that you are 18 years of age or older. Otherwise, individuals under this age will need to have authorization from their representatives.
You may not use our products for any illegal or unauthorized purpose or to violate any laws, regulations, rules and ordinances of the jurisdiction in which you reside (including, without limitation, copyright laws). Such as infringing or violating our intellectual property rights or the intellectual property rights of third parties.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the service provided by Santos without express written permission from us.
You may not insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
The User must not provide third parties with their username or password to access their account.
All disclosure of personal information (not including credit card information) may be transferred unencrypted and involve transmissions over various networks, as well as changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You must not upload, transmit viruses or any other code of a destructive nature that could affect the functionality or operation of the Service or any related website.
The User undertakes to provide truthful and reliable information. If any of the data is incorrect and, for this reason, there is a delay or impossibility in processing the order, or eventual non-delivery, the responsibility lies entirely with the Customer, and Santos declines any responsibility.
A violation of any of the Terms of Use will result in immediate termination of services.
We reserve the right to refuse service to anyone for any reason at any time that is justifiable.
We reserve the right to change these general conditions at any time, provided that any changes will come into effect immediately, and the conditions in force on the date on which the user placed the respective order will apply, provided that the respective payment has been made.
2. Product Information and Contents
We reserve the right to modify the content of this website at any time without prior notice. Furthermore, we will do our best to ensure that all information presented is free from typographical errors, inaccuracies or omissions, and we ensure that these will be corrected immediately whenever they occur.
All information regarding prices, specifications and promotional activities of our products are subject to change without notice. At any time, it is possible to modify or discontinue the product and/or collection without prior notice, except as required by law.
If you purchase a product that has different characteristics to those presented online, you have the right to terminate the purchase contract under the applicable legal terms.
The measurements presented (sizes, weights and dimensions) are approximate and may contain some measurement errors. All Gold (19.2kt) products indicate their weight. However, information regarding the weight of the item is not always provided for 925 Silver items.
It is important to note that all of our pieces are handcrafted and made from natural materials, all by hand. Therefore, their composition and color may vary slightly from the image shown, as well as the actual dimensions and specifications.
The indication of stock availability, as well as delivery times, are merely indicative. If, due to unavailability of stocks, processing and/or shipping delays, it is impossible to fulfill the order within the expected delivery time indicated, Ourivesaria Santos will immediately contact the User, who may choose to maintain the order and accept a new delivery time indicated, or cancel it, with the amount already paid being refunded.
Certain products or services may be available exclusively online through our website and, for this reason, some products may have limited quantities and are subject to return only in accordance with our Return and Refund Policy (see).
If the ordered product is discontinued, Ourivesaria Santos must inform the customer and immediately cancel (in whole or in part) the order, refunding the User the amount corresponding to the price paid for the discontinued product(s).
3. User Registration and Placing Orders
In order to order products through the website, the User may choose to register in advance as a user, by filling in the respective form available online or not, and may also place orders without being registered as a user.
The User is solely responsible for the integrity, veracity and completion of the form required for registration on the platform. The User will also be responsible for keeping his/her access password absolutely confidential.
The User is solely responsible for keeping the data relating to their user registration up to date, such as their address.
Ourivesaria Santos reserves the right to cancel all User accounts and registrations that indicate and/or contain false or incomplete data, corresponding to unidentified identities.
After registering as a user, the Customer may place orders using the virtual shopping cart, following all the steps, paying extra attention when making the payment.
Validation of the order implies the User's acceptance of these general conditions, as well as the price, product characteristics, delivery times and other specific conditions of the transaction.
After completing the ordering procedure, the User will receive an email containing the order number, the products purchased and other specific information relating to the order in question.
The User must immediately inform Ourivesaria Santos if they detect any error or discrepancy in the description of the essential elements of the order, so that it can be duly cancelled.
The User must save the order confirmation email message.
In the event of an error in programming or communications, and whenever the transmitted messages do not reach the recipient in a condition that is perceptible and understandable, Ourivesaria Santos reserves the right to cancel and annul the order, informing the User.
The data registered by Ourivesaria Santos relating to the User and orders placed by him/her will be saved and may serve as proof of the contracting of the orders.
4. Payment Methods
Orders become effective after payment using one of the payment methods available for online purchases on the website.
Orders will only be processed and sent to the User after payment has been made.
The payment methods available for online purchases made through the website are the following: Visa / Mastercard credit card / Payment by Multibanco reference.
The User acknowledges and accepts that processing payments through online platforms involves security risks, i.e., the choice to use any payment method is the sole and exclusive responsibility of the User.
5. Delivery of Orders
The User is solely responsible for, upon receipt of the order, checking that the packaging is in perfect condition and that the items comply with the order request. In cases where the order is visibly damaged, the User must refuse receipt, notifying the distribution company and contacting the following email address: geral@ourivesariasantos.com
With exceptions , the expected delivery time for items in Portugal and the European Union is approximately 48 hours, and for the rest of the world it is approximately 5 to 10 working days, after effective payment for the products.
For the purposes of counting working days, Saturdays, Sundays, national or municipal holidays, days on which a holiday is declared and strike days in the transport or postal services sectors are not taken into account. Deliveries are made on working days. In the case of deliveries outside the European Union, the days in which the order is held for customs clearance in the destination country are not taken into account in the delivery time.
It is the Customer's responsibility to ensure that they are available on the day of delivery of the order.
Once the order has been shipped, we cannot redirect it. If you wish to do so, please contact the carrier directly.
Shipping depends on stock availability and confirmation of payment. If any product is not in stock, we will restock it as soon as possible and it will be shipped within 1 to 2 weeks. If it is not possible to deliver the product immediately, the company will contact you, indicating the new shipping date or the possibility of a refund.
Information about the delivery of the order will be sent by email to the contacts indicated in the Customer's account. Hence the importance of always keeping personal data up to date.
Once the order has been shipped, we cannot redirect it. If you wish to do so, please contact the carrier directly.
After we ship your order, you will receive a tracking number for your order by email. For international standard shipping, tracking of your order may be limited.
6. Right of Free Resolution and Right of Return
Under Decree-Law No. 14/2014, of February 14, the right to freely terminate the contract, that is, the consumer having the right to terminate the contract without incurring any costs and without needing to indicate the reason, may be exercised within 14 days, counting from the day on which the consumer or a third party, with the exception of the carrier, indicated by the consumer acquires physical possession of the goods, in the case of purchase and sale contracts, as determined by article 10/1, b) of the aforementioned DL.
The right referred to in the previous number must be exercised by the User by filling out the Free Resolution Form (legally approved model) on the website.
As a result of the free termination of the contract, within 14 days from the date on which he is informed of the decision to terminate the contract, the consumer will be reimbursed for all payments received, including the costs of delivery of the goods under the terms of paragraph 2 of article 13.
Refunds of payments will be made using the same means of payment that was used by the consumer in the initial transaction, unless expressly agreed otherwise and provided that the consumer does not incur any costs as a result of the refund.
If any of the components of the item sold are missing or if part of the item is not in excellent condition, there will be no refund of the price or shipping costs, and the product will be sent back to the initial shipping address.

7. Communications
Without prejudice to other forms of communication provided for in these General Conditions, notifications sent to the Customer relating to the online store may be sent to the Customer's email address, via SMS or telephone contact.
The Customer agrees to receive any and all communication and/or notification related to the online store, to the address, contact telephone number and/or email address (“e-mail”) indicated in the order process.
At any time, you can request not to receive these communications and/or notifications through the Contact Form or through the “Do not receive the Newsletter” option included in each Newsletter.
8. Warranty/Care and Repairs
All products sold through the website benefit from a two-year legal warranty from the date of purchase by the Customer.
In case of non-conformity of the product covered by the warranty, the User must contact Ourivesaria Santos via the email address: geral@ourivesariasantos.com
To exercise the rights arising from the guarantee, the Customer must always present the respective sales invoice as well as, whenever applicable, the respective guarantee certificate duly dated and signed, duly expressing the non-conformity.
Products that show signs of misuse, improper handling or use contrary to that stated in their instructions will not be repaired or replaced under the warranty. These cases include, but are not limited to, products that show signs of having been dropped, knocked or had an accident; and products that have undergone unauthorized modifications and/or repairs.
All pieces and jewelry are extremely delicate and therefore require some care.
Whenever possible, let your jewelry rest, avoid wearing it during any physical activity and remove it before going to bed. Avoid any exposure to sunlight or heat sources.
Also avoid exposing your jewelry to moisture (water, cream or perfume) and abrasive products. It is recommended that you only clean your jewelry with a soft, dry cloth or, if you prefer, with a soft toothbrush, so that your jewelry can be enjoyed and appreciated by generations of your family.
9. Applicable Legislation / Powers of Portuguese Courts.
The use of the website, as well as all transactions, contracts and business concluded through it, and all interpretation and application of these general conditions, are subject to Portuguese law.
The Portuguese Courts shall have exclusive jurisdiction to settle any dispute arising from the use of the website, transactions, contracts and business concluded through it or the application of these general conditions.
The parties agree that their relations will be governed exclusively by these terms and conditions as well as by the additional information available on the website. In the event of any omission of any condition, this will be considered governed by the customs and practices in force in the distance selling sector, in accordance with the rules of the Code of Ethics and Fair Practices of AMD (Portuguese Direct Marketing Association) and other legislation in force.
